01Who operates this site

This website is published and operated by Wincasa LLC, trading as Wincasa Properties, a licensed real estate brokerage in Dubai, United Arab Emirates. In these terms, "Wincasa", "we" and "us" refer to Wincasa LLC.

By using the site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. We may change these terms from time to time; the version published at the date shown above applies to your use.

02Our relationship with the developer

The projects presented on this site are developed by Imtiaz Developments. Wincasa markets those projects as an authorised sales partner. Wincasa is an independent company: it is not part of Imtiaz Developments, does not build, own or manage the developments, and does not speak for the developer.

This is not the official website of Imtiaz Developments. The developer has not reviewed the content of this site, is not responsible for it and is not a party to any enquiry you make through it. Statements on this site about the developer's projects, milestones and figures are drawn from the developer's own published material and are labelled as the developer's.

Imtiaz, Imtiaz Developments and the project names, renders, photographs and marks shown on this site are the property of Imtiaz Real Estate Investment and Development LLC and are used by Wincasa LLC under its sales partnership for the purpose of marketing the developments.

Nothing on this site grants you any right to use the developer's names, marks, renders or photographs.

03Prices, availability and project information

Prices, payment plans, unit availability, unit sizes, furnishing specifications, amenities, construction percentages and completion dates shown on this site are indicative. They are supplied by the developer, may be rounded or summarised by us, and can change without notice as releases sell, new phases launch or the developer revises its programme.

A price shown as "from" is the lowest price on the developer's most recent list we hold for that project; the unit you want may cost more. Availability shown on a page may be out of date by the time you read it. Always ask Wincasa to confirm the current price, plan and availability for a specific unit before relying on it.

Completion dates and construction figures are the developer's stated estimates. Construction programmes can slip, and neither the developer's estimate nor our reproduction of it is a guarantee of a handover date.

04No offer, no advice

Nothing on this site is an offer to sell, a contract, or an invitation capable of acceptance. A unit is only reserved when the developer accepts a reservation form and the booking amount, and only sold when a sales and purchase agreement is signed. Until then, any unit may be withdrawn or repriced.

Nothing on this site is financial, investment, tax, legal or immigration advice. Rental yields, capital growth, visa eligibility and similar matters depend on your circumstances and on rules that change. General statements on this site, such as the Dubai Land Department fee rate or the golden visa threshold, are given in good faith as general information at the date of publication. Take independent professional advice before committing to a purchase.

05Images, renders and floor plans

Images on this site are artist's impressions, computer-generated renders, show-apartment photographs or construction-progress photographs supplied by the developer. They illustrate the developer's design intent; the finished building, its finishes, views, furniture and landscaping may differ. Floor plans are indicative, not to scale, and subject to the developer's final drawings. 3D tours are hosted by a third party and show a model, not necessarily the unit you would buy.

06Enquiries and reservations

Submitting an enquiry through this site asks Wincasa to contact you; it does not reserve a unit or create any obligation on you to buy or on us to sell. Enquiries are handled by Wincasa under our Privacy Policy and are not sent to the developer unless you decide to reserve.

If you decide to reserve, the reservation, sales and purchase agreement, payment plan, escrow arrangements and handover are governed by the developer's documents and by Dubai law. Those documents take precedence over anything on this site. Wincasa assists with the process but is not a party to the sale.

You must be at least 18 and legally able to buy property in Dubai to use the enquiry forms. Do not use the forms to send unlawful, abusive or misleading content, or to test or overload the site.

07Using this site

You may view the site and print or save pages for your own personal, non-commercial use in considering a purchase. You may not copy, republish, scrape, frame or redistribute its content, or use it to market property or services of your own, without our written consent and, where the developer's materials are involved, the developer's.

The text, layout and code of this site belong to Wincasa LLC. The developer's names, marks, renders, photographs and plans belong to the developer and appear here under our sales partnership.

08Links to other sites

The site links to WhatsApp, Matterport, Google Maps and, where indicated, the developer's own website. Those sites are not under our control; we are not responsible for their content, availability or terms, and a link does not mean we endorse them.

09Availability and liability

We try to keep this site accurate and available, but we do not promise that it will be error-free, uninterrupted or free of viruses, and we may change or withdraw any part of it at any time.

To the fullest extent permitted by law, Wincasa LLC is not liable for any loss or damage arising from your use of, or inability to use, this site or from reliance on information on it, including loss of profit, loss of opportunity or indirect loss. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything that cannot lawfully be limited.

Your rights in respect of a purchase are set out in the developer's sales and purchase agreement and in Dubai real estate law, and are not affected by these terms.

10Governing law and disputes

These terms, and any dispute or claim arising from your use of this site, are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer protection you enjoy in the country where you live.

Any reservation or purchase you enter into is governed by the developer's reservation form and sales and purchase agreement, which contain their own governing law and dispute provisions and take precedence over these terms in relation to that transaction.

11General

If any part of these terms is found to be invalid or unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms and the Privacy Policy are the whole agreement between you and Wincasa LLC about your use of this site; they do not affect any separate written agreement about a transaction. These terms are written in English; if a translation is provided, the English text prevails.
